1. Intra-EU BITs and Intra-EU Disputes University of Vienna & Saarland University, 7 March 2016 EU Member States have concluded approximately 1.400 IIAs with third (i.e. non-EU) countries and 190 IIAs with other EU Member States (Intra-EU BITs). These Intra-EU BITs have been the basis for investment disputes in multiple investor-state dispute settlement (ISDS) cases that are very controversial. Of roughly 140 cases instituted against EU Member States more than three quarters are Intra-EU disputes. While IntraEU ISDS seems to become an attractive means of dispute resolution, the EU Commission is asking EU Member States to terminate their Intra-EU BITs arguing that they would not be in conformity with their EU Law obligations. This conference seeks to address the EU, domestic and public international law issues raised in this context.

Good Governance of Nudging Academic Matinée with Cass Sunstein, Harvard University, Center for Consumer, Markets & Politics, CCMP, Netzwerk Verbraucherforschung Baden-Württemberg, Zeppelin University Friedrichshafen & Humboldt European Law School (HELS) at Humboldt University Berlin, Unter den Linden 9, Raum 213, 15 March 2016, 11:30 am - 3:00 pm (registration required until 8 March 2016) Nudging is perhaps the most-discussed innovation in politics, law, and economics of the last decade. A merger of behavioral economics and regulatory theory, nudges aim to steer people’s behavior while preserving freedom of choice to a maximum. Such policies have recently been adopted by a number of countries and organizations including the US, the UK and the EU as well as the World Bank and the OECD. However, the new paradigm has also drawn fierce criticism, including reproaches of fostering manipulation by governments and of encroaching on individual autonomy and dignity. Against this backdrop, the event brings together eminent Mitteilungen der Gesellschaft März 2016 5 scholars from different disciplines to explore the political, philosophical and economic boundaries of nudging, and to inquire into the legal architecture required to “nudge for good”. We specifically welcome distinguished scholar Prof. Cass Sunstein from Harvard Law School as keynote speaker.

Trotz verbreiteter Skepsis gegenüber der Europäischen Union und einem neuerdings zu beobachtenden critical turn in den Rechts- und Politikwissenschaften gegenüber dem Unionsrecht ergeben Umfragen immer wieder, dass in den Außenbeziehungen eine stärkere Rolle der EU befürwortet wird. Daher soll dieser Bereich im diesjährigen Hallstein-Kolloquium im Mittelpunkt stehen. Dabei werden zwei Ziele verfolgt. Zum einen soll das Kolloquium sich einigen drängenden Problemen widmen, denen sich die EU zurzeit gegenübersieht, und im Austausch auch mit Vertretern der Praxis diskutieren. Zum anderen soll versucht werden, die sich stellenden bereichsspezifischen Fragen vor dem Hintergrund einer Divergenz zwischen interner und externer Handlungsorientierung der EU zu betrachten. An verschiedenen Stellen der EUVerträge, aber auch in der täglichen Praxis ergeben sich je nach Politikfeld unterschiedlich intensive Bindungen an diese Werte. Die ausgewählten Bereiche sind die Menschenrechte, auch im Rahmen der aktuellen Massenfluchten aus dem Nahen Osten, Afrika und den Westbalkanländern, die Nachbarschaftspolitik, die Verteidigungspolitik und der Außenhandel. Jeweils stellt sich nicht zuletzt die Frage, wie Spannungslagen zwischen interner und externer Wertorientierung im demokratischen Prozess zu verhandeln sind.
